Legal question about a old debt?

I don’t need anyone putting me down and calling me a deadbeat PLEASE just some advise!!
In may of 2008 I had a payday loan through a on line company (bad idea I now know) they were to take the payment out of my checking, when they tried to take the money they notified me and said there was not enough to cover the payment. Turned out a direct deposit that was supposed to be made wasn’t. I said I would mail a money order which I did. I thought this was cleared up. I have looked high and low for my M.O. receipt and I cant find it, therefore if said company says they didn’t receive the payment then I do feel obligated to pay it yet again as its my bad that i lost my proof of payment…

Now over a year later i get a call from a company Eclipse Resolutions LLC in New York they have a called 4 or 5 times and leave a message I have tried to return their calls to find out what it was they wanted. When I did get a answer the person I was supposed to talk with was never around and there was no voice mail. So I continued to try and reach someone. I called this AM and spoke with someone they are calling in regards to the payday advance I described. I told them I need to see some documentation, something in writing…. OK fine but the secretary was out maybe if I call back the next day they can email or fax me something.. so I chat with this person for a bit, I expressed that IF I receive something in writing and this seems valid I can work out some type of agreement. But I was not unwilling to just send them money…. His response was “well you have screwed up get a lawyer” and he hung up on me…
So I called back spoke with someone else (at that point I still didn’t know what company I was dealing with) I tried to talk with him and was interrupted a number of times unable to ever finish a sentence, he then told me that If I didn’t call back tomorrow and set up a payment agreement and get them a payment via, checking account or debit/credit card by the 3rd that they were sending paper work to my County because I wrote a bad check across state lines and committed a felony offense. I told him again that if they sent me something in writing to validate the debt I would work out a plan to pay the debt starting 8/15 the earliest I would have money available.. He then proceeded to tell me that they were trying to work with me and it was what it was, if i didn’t have the money to them by the 3rd then i can expect it to be turned over to the county and he could no longer speak with me as he was leaving the office and the soonest I could get something in writing was via fax or email tomorrow IF I called them tomorrow and he wouldn’t even take my contact info (email/fax/mailing) so that first thing tomorrow they could get it sent to me. I also asked why I had not received anything up to this date and his response was they will not waste money mailing me a bill.

I am wondering if you can please tell me how to handle this situation? like I said if the original company claims they didn’t receive payment then I feel obligated to pay it. But I also do not have a good feeling about this other company. I am at a loss at this point and unsure what to do.
I have been trying to research this company and have came up empty handed. When they leave a message they say a name, and a call back number and case number: xxxxxx

I appreciate any advise that you can give me. I have contacted a lawyer for his advise but haven’t heard back yet…

They told me that another company purchased the debt and they represent that company, they themselves are a litigation company…. I agree if i can tfind the reciept then i need to pay it and i am willing to do so, If they can show me in writing that i owe them and that it would be reported on my credit as paid in full… he told me they can email me an agreement but its up to the credit agency to remove it from my report.

Legal question: On a debt and whats ligitimate?

I did use cash for the money order, to clear up the mistake with my checking account. but i can not find the reciept from the money order

Question about NC pawnshop laws?

A few weeks ago I got a loan on my HDtv. The other day I went in to pay off what I owed and get my tv back. The guy at the pawnshop tells me that the pawnshop was broken into and my tv was stolen. He then tells me that the most they can give me for my tv is the amount I got loaned($50),but the tv is worth way more than that. I then go home and read the pawn ticket that I signed when i pawned it and it says that they have to try and find a replacement tv. I then go back to the pawnshop and tell the guy working what I read in the contract. He basically tell me that I’m wrong and that they dont have to get a replacement, just reimburse the money i got on loan. He then tells me to go home and theyll call me when they get a settlement from the insurance company.

This kind of sounds like BS to me. The pawnshop cant get the replacement value for my tv (from insurance) and then only give me $50 for it, can they? I dont know North Carolina law good enough to know if they’re trying to screw me or not, so any info on this would be greatly appreciated.

New Question – Apartment Maintenance Worker Labor Laws?

Another question have have… I worked for Millennium Management based in Beachwood, Ohio as a aprtment maintenance worker. My contract with them was, a hourly salary and a apartment that was valued in the contract as so $xxx a month. Now, the free apartment was not taxed and not on my tax statements at the end of the year that they gave me. But, when I missed a day of work, they charged me a pro rated amount of rent for that day and deducted it from my payroll check. Is this legal for them to do, or are they trying to cheat the IRS. Its not fair to me either, because if I try to collect unemployment or apply for a loan, will they consider the free rent as part as my salary. No, they wont. But how is it free, when I have to pay rent when I miss work?

I have a question about loan Modifcation and your credit?

March of last year I lost my job through no fault of my own company went out of biz. I have a mortgage where my APR is 9%. In July I called Bank of America where I bank and ask about a refinance she said they cannot do one because one we owe 155k home is worth 120k and I am on unemployment. She did offer the making homes affordable program and switched me over to the loan modification dept. I talked to them and they took all of my income and expenses over the phone then they asked me to fax pay stubs, hardship letter, unemployment proff. they told me it will take 30-45 days to review the info. Did not hear anything from them and then I called on day 45 they said they are still reviewing it. I thought this was a wash, we have also made our payment on time every month. Then this last week Fed-ex showed up with an envelope with a one page letter from BoA letting us know what a trial payment will be our Original payment was 1600 trial payment is 1090 it also said in a few days you will get more details. Yesterday Nov 2 another package showed up from Fed ex this time a thicker package with a check list of more pay stubs, tax documents ect. This also had three cupons with a trial payment of 1077 one due Dec 1, Jan 1, Feb 1. I still have not paid anything for Nov yet. So i went online to make a Nov payment and it was blocked and said call #1866 as this account has a special curmenstance. I called them up talked to a rep they said you are now in a trial payment asked it they can set up an automatic payment for that I said sure they set it up to be drafted Dec 1st. I asked him about the Nov payment I have not made one yet he told me dont worry about it. I also asked about if this was going to hurt my credit score he told me there is no way shape or form it will hurt me credit score. Only way it will hurt your score if you dont pay your trial payment. I have been reading some people have been taking a hit on there credit even as they where told by there lender it will not. I recently got an offer from a credit card that gave me a 4.99% until balance is paid in full, they gave me a check to write out on my line of credit to my checking account this was 7k. I would hate for my loan company to put a late then my credit card would come back with the universal defuate clase and jack my APR up. Do you think they can disclose this in writting or record a conversation with them.
Any thoughts would be great.
