Crazy in-laws…what would you do? Sorry it’s long…?

May 17th, 2010

My Father-in law (FIL) recently lost it and called my husband and myself some horrible things, and has even said mean things about my Mom. It all started when (after getting pregnant with baby #2), my husband and I gave some of my husband’s old furniture to my Mom so we could get some toddler furniture. Besides the fact that my FIL gave it to my husband 12 years ago, it is antique, and neither one of us like it. My Mom planned to hold it until my 1st child was old enough to see if he would like it for himself. Anyways, my FIL flipped out and said that my husband cannot give the furniture away (even though it was more of a loan) to someone outside of the family. He then called my husband names, threatened him, said that I was controlling, and called my Mom controlling.

My husband and I have seen some strange behavior from my FIL before…for example, he didn’t talk or visit his 98 year old mother in the nursing home for over a year b/c he had to pay capital gains taxes on an inheritance from her. Needless to say, he is a little off. Well, we have overlooked most of his past tirades, but cannot overlook personal attacks and threats. We gave him back the furniture (he is storing it along with his 7 other furniture sets) b/c we don’t want to hear his calls and threats anymore. Also, we have since cut all ties, have not answered his calls, and do not plan to see him anytime soon. He has not apologized or anything and continues to leave mean / strange phone messages. Now, he is acting like he is the victim and that we are keeping him from his grandchild (without warrant). Frankly, I do not want my son or my future baby around him when he is acting crazy. He can be quite scary.

Well, my baby is about to turn 2, and my family is asking if we are inviting my FIL to his b-day party. My husband says no way, and I agree. What would you do? Part of me feels guilty…but then I replay some of the mean phone messages from him, and I don’t feel so guilty. Has anyone else ever cut out their baby’s grandparents?

Oh, my mother-in-law is deceased. My FIL is remarried, though. There is a lot more crazy things I could tell you about my FIL, but I don’t want to write a book. Let’s just say that I have even considered getting a restraining order.
I should mention that the furniture was not special to my FIL…it was a gift to my husband. We would’ve asked my FIL if he wanted it, but he has 5 bedrooms (complete with furniture sets) and 2 full spare sets in storage (i.e. his basement). His house is packed….he likes stuff and does not throw anything out. Again, I should re-iterate…my Mom was holding the furniture for us until my son was old enough to take it from her (if he so desires).
Also, my FIL is not mentally-ill…at least he has not been designated so. He just is mean and stubborn. He has done some crazy things, though.
Addtn: My FIL has caused many scenes in front of family. He was also once kicked out of a nursing home (when he was yelling at his 98 year old mother, who has never said a mean thing in her life by the way).

How long should a land appraisal take?

May 13th, 2010

I own 40 acres of raw land I am trying to develop through a loan with my bank. Everything is good to go except the appraisal.

My bank requested an appraisal on raw land I own on May 4th. In the next couple of days I faxed the appraisal company deed information, maps (erosion and satellite), similar property listings, paperwork from the county showing I could build (long and complicated story, but I’m basically grandfathered into the land so I can build on it). I drove 5 hours to meet them on May 8th to show them the land.

On May 11th, my bank and I received one email regarding the condition of the roads may have an effect on the appraisal (we had to take the back road because the neighboring ranch that belongs to my dad that the main road goes through was closed due to cattle being herded, so it was a really rough road that rarely gets used, but I explained this to them and the bank). There is also a second road that we did not take that comes from the opposite end of the property that leads to town, so I really don’t see how this is an issue.

Regardless, that was the last communication with them. The bank requested an update on May 18th, with no reply. I requested one today with no reply. We paid on the 8th of May for the appraisal in full as they required before they would see the land. The bank says they have never seen an appraisal take so long. They are the only appraisal service in the area. Any suggestions?

I was Fired for Asking for my 60 day delayed Payroll. How long do they have by law to pay up?

January 30th, 2010

So yesterday afternoon, I was fired when I sent an email asking for the status of payroll. I had been working for over 60 days not without compensation. I used to get checks via ADP from the company but its been 2 months since they were able to make payroll.

When I asked for SOME funding since I’m starting to get letters from my Car Loan, my boss fired me.

How long do they have by law to pay what’s owed to me? If they are not paying me, they are not paying the government, my IRA, or insurance. As of my fired date, they owe me apx $6,500 gross.

A fellow coworker mentioned to me that since I was FIRED their time frame has shrunk.

A little help with this situation would help. How would I enforce any of this?

Thank you.

Not For Long – Pay Day Loans Warning

January 14th, 2010

Pay day loans are short-term loans. Needless to say, this type of financial solution takes effect in a matter of days, 31 days the maximum, depending on your lender.

In addition, pay day loans are for emergency purposes, for expenses that crop up before you receive your paycheck for the month. Because the amount that you can borrow is not that substantial, pay day loans should be used for expenditures that will need your financial attention for an extended period of time.

The rationale of pay day loans is simple: you need to pay back the amount you’ve borrowed on your next payday. It’s easy enough to understand and it does not need further explanation.

However, perhaps due to today’s trying times, some people use pay day loans far longer than it’s supposed to be. They keep in renewing their loans. When this is the case, they fail to realize that they will be incurring enormous finance charges and the interest rates could skyrocket to as high as 4 figures (e.g. 1000% in APR)!

Let the Statistics Speak

When this happens, you feel like there’s no way out. If you say that you’ll only avail of on payday loan and not come back to your lender after completely paying it off, then try to ponder on this. One of the payday loan lenders in Colorado, for instance, estimates that among their customers, only 2% of them take one loan.

Now this may come as shocking news because pay day loans are supposed to be availed of for expenses that do not meet your monthly budgetary requirements. If you have to be realistic about it, this means that if you are able to properly budget — and of course, lived within your means — then you should not have been confronted with a need to make a pay day loan often. But of course, emergencies crop up from time to time. However, if they sprout like mushrooms on a regular basis, then perhaps you should not label them as an emergency and you need to adjust your budget accordingly this time.

Further, a Wall Street analyst reveals that on the average, a pay day loan costumer makes 11 transactions annually. This is like making a pay day advance every month! Surely, there is something wrong with the way an average customer handles his or her money!

Getting into a Debt Cycle

This is a question more about habit and than about budgeting skills. If customers avails of pay day loans 11 times out of 12 payrolls in a year (supposing that paychecks are given only once a month), then individuals have grown dependent on this financial option. Perhaps, it started out as a sincere need of money, and then seeing that getting a pay day loan is fast, the person avails of another, then another, then another. In short, the customer has been living in debt.

When you are in this deep hole of financial dependency, then the nearest thing that you’d get to is a debt cycle. It will be hard to get out of it as your coming paychecks are already spent.

Pay day loans should be used for the mere purpose that they are made available to the public. They should not be used as a means of fuelling an impossible lifestyle. Otherwise, you are just getting yourself into more trouble, rather than financial independence.
