Home Loan Agreement- is this legal?

This is regarding my father in law’s home. He doesn’t speak English well, and he tells me that since the very day he bought the home, he was under the impression that it was a 15 year loan.

I had the bank send me the original contract.. here are the basics:

-In return for a loan that I have received, I promise to pay US $ 83,250.00
-Interest will be 7.875%
-My monthly payment will be in the amount of $603.62
-I will make my first payment on Dec. 1, 2003.
-Maturity date is Nov. 1, 2033

Okay, so if first payment is on Dec. 1, 2003, and maturity date is Nov. 1, 2033- that means this is a 30 year loan.

But $603.62 for thirty years plus a 7.825% interest = well over $200,000!

Is it legal to charge more interest than the price of the property itself?!

I am having my father look for his original copy of the contract– but I’m wondering if someone pulled a fast one on him.
I guess I sound ridiculous asking this, since everyone that is answering says it is completely normal. I have never purchased a home and did not realize that the bank can charge $120,000+ worth of interest on a $83,000 loan. That’s crazy!

Well now I know! I hope I never sign a contract under terms like that.

I was 11 days late with my car payment they sent one of there representatives to my house is that legal?

My car payment was due on the 14th it’s was money gram on the 25th on the 29th they sent one of there collection people to my house. Saying I owe interest on my law which I refuse to pay. When I’m one day late this finance company calls my house, my job my family even when I tell them my payment is gonna be late they still harass me until the payment is made, and this time they sent someone to my house to collect a payment that was already paid. My account was transfered to one of there other offices and I’ve never paid any interest payment up front on my loan. I told them to stomp call my job and my family members, my job has even told them to stop calling my place of work and they continue to call. I know to stop the calls is to pay my payment on time, but things happen as everyone knows. Do you know what she told me. Get someone to pay the loan off and they will stop harassing me. Can they do this legally by sending someone to my house like that. It’s not in my contract and I told them to send me a copy showing me they can do this. I’m in New Jersey.,

What are my legal options when my car was mistakenly repossessed?

Last month my car was (correctly) repossessed on 3/11/09. I was able to borrow some money and get it back the same day. Then this past Sunday, 4/19/09 I got a knock on my door at around 8pm. When I answered, it was the same repossession company that had taken my car the month before, and the guy at the door told me he was here for my car again. I was very confused, as my payment in the middle of March had been made in full and up to date, and my payment in April had been made a day early. I showed the guys (there were two, which is one of the reasons I didn’t come downstairs legally armed) my copy of the payment from March, and although I didn’t have a paper copy of my April payment, I was able to get the one guy to listen to the automated recording w/ the loan company stating that I had no payments due, thus showing that I was paid up. I said there was no possible way they were there to take my car. They then showed me their work order, which was originally generated on 3/31/09. This gave me further confusion, as even if there was some kind of problem with my April payment, there work order was generated before that payment was due. I again stated they weren’t taking my car, but they told me that there was nothing they could do, they had their orders. Rather than risk any serious altercation, I opted to hand over my spare keys and allow them to take the car. I have terrible luck, and I decided something must have gone wrong and I was indeed at fault.

After calling off work (I am almost forbidden to take off work on Mondays as my job duties have to deal w/ preparing for new music, movie, and book new releases that come out every Tuesday, and since I don’t have an understudy or anything, I’m the only guy in the store who can do it, but I was able to plead to the right boss and instead just had to bust my ass even harder on Tuesday before the store opened), I tried to get some sleep. The next morning, when I called the loan company, I eventually was told that it was a mistake, and that my car was indeed not scheduled to be repossessed. The loan company informed me it was a paperwork error with the recovery company, and that I could contact them myself and arrange to get my car back. I called the recovery company, and was given the number to one of their drivers and told to call him. When I called, he informed me he needed to get the release faxed to him, and that he’d call me back. An hour and a half later, I had not received a phone call, so I called the recovery company and they told me they’d call their driver and make sure he got the fax. About 15 minutes later I finally got a call from the driver. He asked me when I could come pick up the car. I was pretty pissed off at that point, that they had towed my car an hour away and now expected me to pick it up, but I was more worried about getting my car back before some other paper work error caused them to mistakenly auction it off or something worse.

I eventually got my car back. Some of the things I was most upset about is that not a single person apologized to me. The loan company didn’t go to any steps to get my car back for me, and instead left me to deal with the repossession company. The guys there made me wait around and then expected me to pick up my own car.

What kind of legal options do I have? I’ve seen a few sites stating this is grand theft auto, but I’m not sure if this applies in Pennsylvania, and if it does, what the statute of limitations would be. I’m not really that interested in spending my own money to sue anyone, but I wonder if maybe I can get something from one or both of these companies in compensation. I’m thinking maybe a month forgiveness on my loan and a full tank of gas maybe? Anyone have any advice?

Legal question about a old debt?

I don’t need anyone putting me down and calling me a deadbeat PLEASE just some advise!!
In may of 2008 I had a payday loan through a on line company (bad idea I now know) they were to take the payment out of my checking, when they tried to take the money they notified me and said there was not enough to cover the payment. Turned out a direct deposit that was supposed to be made wasn’t. I said I would mail a money order which I did. I thought this was cleared up. I have looked high and low for my M.O. receipt and I cant find it, therefore if said company says they didn’t receive the payment then I do feel obligated to pay it yet again as its my bad that i lost my proof of payment…

Now over a year later i get a call from a company Eclipse Resolutions LLC in New York they have a called 4 or 5 times and leave a message I have tried to return their calls to find out what it was they wanted. When I did get a answer the person I was supposed to talk with was never around and there was no voice mail. So I continued to try and reach someone. I called this AM and spoke with someone they are calling in regards to the payday advance I described. I told them I need to see some documentation, something in writing…. OK fine but the secretary was out maybe if I call back the next day they can email or fax me something.. so I chat with this person for a bit, I expressed that IF I receive something in writing and this seems valid I can work out some type of agreement. But I was not unwilling to just send them money…. His response was “well you have screwed up get a lawyer” and he hung up on me…
So I called back spoke with someone else (at that point I still didn’t know what company I was dealing with) I tried to talk with him and was interrupted a number of times unable to ever finish a sentence, he then told me that If I didn’t call back tomorrow and set up a payment agreement and get them a payment via, checking account or debit/credit card by the 3rd that they were sending paper work to my County because I wrote a bad check across state lines and committed a felony offense. I told him again that if they sent me something in writing to validate the debt I would work out a plan to pay the debt starting 8/15 the earliest I would have money available.. He then proceeded to tell me that they were trying to work with me and it was what it was, if i didn’t have the money to them by the 3rd then i can expect it to be turned over to the county and he could no longer speak with me as he was leaving the office and the soonest I could get something in writing was via fax or email tomorrow IF I called them tomorrow and he wouldn’t even take my contact info (email/fax/mailing) so that first thing tomorrow they could get it sent to me. I also asked why I had not received anything up to this date and his response was they will not waste money mailing me a bill.

I am wondering if you can please tell me how to handle this situation? like I said if the original company claims they didn’t receive payment then I feel obligated to pay it. But I also do not have a good feeling about this other company. I am at a loss at this point and unsure what to do.
I have been trying to research this company and have came up empty handed. When they leave a message they say a name, and a call back number and case number: xxxxxx

They told me that another company purchased the debt and they represent that company, they themselves are a litigation company…. I agree if i can tfind the reciept then i need to pay it and i am willing to do so, If they can show me in writing that i owe them and that it would be reported on my credit as paid in full… he told me they can email me an agreement but its up to the credit agency to remove it from my report.
