Can anybody tell me anything about child support laws?

April 28th, 2010

I’ve asked about child support before, but this is a different situation.

My boyfriend and I moved to a new town and got new jobs over the summer. He has an 8-year-old daughter with his ex-wife, to whom he pays child support. The first paycheck for the new job did not take out the child support, and neither did the second. So he calls his ex-wife and tells her that she needs to get in touch with the agency or whatever and get it seen about. To this day, no child support has been taken out and he started the job one of the last couple days of June.. perhaps the 29th.

Yesterday, she leaves me a message on facebook (she next to never pays her phone bill) asking for my boyfriend to call her, it’s important. I tell him and he decides he’ll call her this weekend when we go back to our hometown to visit. This morning, his step-mother calls me to tell me that my boyfriend is in some serious sh**. I’m not exactly sure how it went down, but because he did not contact the state to tell him where he worked, his license has been suspended as of September 1. Which was 15 days ago. And we have had no knowledge of this! Now they want to take him to court to get $2000+, which is double what he should actually owe if he missed 2 months of payments!

Our financial situation has been terrible since we moved (the worst move of my life). My income was supposed to be a nice 33k, but because of certification issues and other things, I am making student wages until I can take care of it (probably the end of the year). So I basically bring home the rent check at the end of the month. I also have a student loan I am paying back ($200/month), plus we have power, water, cable, cell phone, insurance, etc… other bills that HE is having to pick up! We were able to save a little under $1400 to help get us through the end of the year. But it seems all of that is going to go towards repaying the child support.

Now after all of that.. is there anything we can do about how much is owed? It’s $120/week.. and it should only add up to something over $1000. Can we set up a payment plan? There is no way on this Earth we can cover it all at once!!

Also, bonus question I guess… we are in Georgia. I was told that the child support laws changed to include the mother’s income as well as the father’s. Well, if she and her current husband don’t work (lazy SOBs), wouldn’t that only raise his support amount? Should we even try to go back to court to readjust the amount? She doesn’t have young children to keep at home.. all of her kids, including my boyfriend’s, are in school.

Sorry such a long question!! Any help? Or anybody want to make me feel any better about this situation???? :) I could really use it!!
Okay, I am understanding that it is his responsibility to inform the agency.

No, neither the mother nor stepfather work. Just plain sorry (my opinion!). I believe they are living on the child support and any money from the stepfather’s parents (with whom they live). They may also have welfare, since my boyfriend had to sign some papers to confirm his contribution dealing with food stamps.
LadyB — EXACTLY! They are just living off what he gives them. And she calls all the time asking for money…. I mean, it’s not like we want sweet girl to go without, but it’s borderline ridiculous. We have enough of our own financial problems without worrying about his ex’s! She had a job for 3 months though, got to give her that *eye rolling.*
maccrew – i only mentioned that they were in school to say that there was no reason for her to sit at home on her @$$ and not have a job.

Question about NC pawnshop laws?

April 1st, 2010

A few weeks ago I got a loan on my HDtv. The other day I went in to pay off what I owed and get my tv back. The guy at the pawnshop tells me that the pawnshop was broken into and my tv was stolen. He then tells me that the most they can give me for my tv is the amount I got loaned($50),but the tv is worth way more than that. I then go home and read the pawn ticket that I signed when i pawned it and it says that they have to try and find a replacement tv. I then go back to the pawnshop and tell the guy working what I read in the contract. He basically tell me that I’m wrong and that they dont have to get a replacement, just reimburse the money i got on loan. He then tells me to go home and theyll call me when they get a settlement from the insurance company.

This kind of sounds like BS to me. The pawnshop cant get the replacement value for my tv (from insurance) and then only give me $50 for it, can they? I dont know North Carolina law good enough to know if they’re trying to screw me or not, so any info on this would be greatly appreciated.

ontario canada repossession laws?

March 31st, 2010

I am looking for a source for what laws/procedures a company has to follow before repossessing a vehicle in Ontario Canada. I think there is a 10 day notice they have to give you..however my lender is based in Texas and by the time I get the notice it is expired.

My loan is now one payment from being over and they are claiming I have to pay $900 in fees for the two times they put my car out for repo (but did not pick up because I paid even before getting the notice in one case and same day as getting it in another). My bone of contention is that since I did not get the notice till it was expired and the car was out for repo…..that should be illegal. When they are based in Texas should the 10 days not start from when I recieve the notice???

advice please.
ok…to the person who said I was behind and should have to pay for that…I agree there is extra interest, that is what interest is all about. that is not the issue here. bad answer.

to oklatom, yes it does take that long to get registered mail here. the 2 days after postmark is true if it was mailed to me from within Ontario…not the far end of another country.

I have had one of the two charges taken off so far because they put it out for repo illegally. I had paid more than 2/3 of my debt so the Ontario Consumer Protection Act comes into play. They should not have put it out…so they took that charge off.

I am awaiting word from the Gov’t of Ontario on who regulates the 10 day warning.

Please do not try to answer this thread unless you have knowlege of the ONTARIO law I am asking about. American answers referring to American law does not apply here. The contract was initiated in ONTARIO
thanks.
Thanks Goood Deeds, but I checked with them and they say they do not apply here because my issue is not with the car dealer, but with the car financer.
Oh, and also oklatom. I have never broken a payment arrangement with them. (not including the original contract of course)

They are fortunate I paid the entire amount since it was included in my bankruptcy.

Why are laws different for women than men?

March 23rd, 2010

On the Headline News, Nancy Grace was talking about this woman who was driving her vehicle with her two children, and she was drunk. It is all over the news, she is looking at a year in jail. This is her second offense, same thing different day. However, if this was a guy who had drove drunk with his kids he would probably be looking at life in prison without the possibility of parole. The laws are so different for men than women. Did you know that when it comes to child support, a guy has to pay something like 44% of the average income in his state? If a woman ever had to pay child support to a man she only has to pay 23%. Where is the justification of that? I believe that the law looks at women as homemakers or something. Where is this equality that they sought when they wanted to vote? Why is their such a difference? In every aspect of life, from approval of a loan, to child support, to sex, to whatever, why is society like this, and why doesn’t someone fix it?

New Question – Apartment Maintenance Worker Labor Laws?

March 20th, 2010

Another question have have… I worked for Millennium Management based in Beachwood, Ohio as a aprtment maintenance worker. My contract with them was, a hourly salary and a apartment that was valued in the contract as so $xxx a month. Now, the free apartment was not taxed and not on my tax statements at the end of the year that they gave me. But, when I missed a day of work, they charged me a pro rated amount of rent for that day and deducted it from my payroll check. Is this legal for them to do, or are they trying to cheat the IRS. Its not fair to me either, because if I try to collect unemployment or apply for a loan, will they consider the free rent as part as my salary. No, they wont. But how is it free, when I have to pay rent when I miss work?
