MAJOR ISSUE WITH CITI-FINANCIAL PLEASE HELP !!!?

March 26th, 2010

Oka here is the spill I need all the advice I can get !! In march of 2008 I called citi-financial to make a car payment I had used them to finance my car. I was told my account was paid in full. I was shocked because I didn’t know who would have paid off my account I owed 8,000.00. After calling around to family members my father-in-law said he paid off the car. I was getting ready to have my baby and It was a present to me he said. I had a mustang and he knew we needed something more sutible. A few days later my Title came, a payoff letter thanking me for my buisness, and the original loan contract I signed the day I bought my car stamped “paid in full “. I was so happy !!! Well, in July of that year I finally found a man willing to trade his trail blazer to me for my mustang. even trade. we exchanged titles went and registered our cars. case closed. So I thought !!! In November of 2008 I got a call from a collection agency saying I owed over 2,000 in past due payments. I explained the car was paid, faxed them a letter, and the contract stamped paid in full and never heard a word. The other day another comany contacted me and said I still owe the money. I said my father in law paid it. They called me a liar. I am scared to death. I have all documets showing the car was paid in full, i recieved a title, I don’t even own the car anymore !!! my father-in-law can’t find the money order reciept since it was a year later. I am worried my father in law may have lied and not paid it. Could citi-financial have made a huge mistake and sent all that on accident. If so, can anything be done at this point if they have no title, no contract, nothing !! I want to believe my father in law is telling me the truth but I don’t know what to do from here !! I need alll the advice I can get !!!

Help! Having a problem getting a paid in full letter from student loan provider.?

March 14th, 2010

I took out a student loan a few years back for $1000. I defaulted on the loan shortly after I withdrew from school. I have been wanting to return to college but because I defaulted on my student loan could not get another student loan or financial aid until I repaid the loan. I repaid the loan a month ago in full, and the loan garuntee Michigan Garuntee Agency said they would send a letter to my school’s financial aid department stating that it was paid in full and that I was eligible for benefits again. Everytime I call them asking where the letter is, or why it hasnt been faxed they keep giving e the run around. First, they told me that they had to wait 10 business days by law before they coud send it. So I waited that period of time. Now, everytime I call and ask for them to send it, they say that a supervisor has to sign off on it before they will fax it. Each time, they say that it will be sent out the first thing the next morning, but I call my school and they have no faxes. I call the Michigan Garuntee Agency back, and they say that there were no supervisors there that day to sign off on it, and they will be back the next day. This has been happening for 3 weeks. What can I do? Please help.
PS: I haven’t been contacting Sallie Mae, I have been contacting Michigan Garantee Service since Sallie Mae sold my loan while it was in default. So I have to go through the state garantee agency since Sallie Mae wants nothing else to do with me. When do the mark it paid in the national student loan database?

Foreclosure Help: my options list?

March 11th, 2010

My grandmother is currently in foreclosure and she’s trying to do a loan moddification via her loan company saxon mortgage, and if we are approved for the loan moddification, we need to pay $2,500-3,000 toward our escrow and pay lawyers fee’s(or most of lawyers fee’s). then we can have our interest rate lowered, as well as our payment. and whatever payments that we are behind as of now, will be placed at the end of our loan….and no more FORECLOSURE!!!…… We also have an option to go with a forclosure lawyer, here’s the email the lawyer sent me:

Robert,

Nice speaking with you today. As we discussed, the Foreclosure Defense Law Center specializes in stopping foreclosure and modifying your loan. We are a law firm with a team of loss mitigation negotiators and loan modification attorneys. (www.foreclosuredefenselawcenter.us)

The first step in the loan modification process is for our legal team to review your information to determine if we can help you in your situation. Also, if you have a copy of your original loan documents (RESPA/TIL), we can conduct a forensic audit to see if you were a victim of any predatory lending. If these documents are available, please fax back to us at fax #786 345-5809.

My contact information is toll free #888 572-8387 x323, or email jhopkins@foreclosuredefenselawcenter.us.

Thanks again and I look forward to speaking with you soon.

They require a $2,000 retainer but they say that they will hold the money in an escrow account until the 45 day loan moddification is finished between the attorney and Saxon, they claim that they can 100% take care of the whole process and make sure that we won’t have to pay the up front costs to Saxon and get our loan current and fixxed. The say that the process is 45 days and would freeze our forclosure so we would not be evicted and they will solve our problems……….Help please with advice!!!!!

Debt Collection Help?

February 25th, 2010

I have a past due debt and Collector called me (collector is calling from a law firm), they want to set up a payment plan with me, but the amount they are asking per month is too much. I told them the amount I can afford to pay per month and they said it’s too low. They are asking for atleast $100 but I can only afford $30 per month due to other outstanding bills. I am only making enough to pay some bills and I have been getting a pay day loan every pay day just to get by. My hours at work have been cut and I can’t afford a baby sitter for my 1 yr old so I can’t work full time. Well, the collector said that if we can’t agree on a payment then they will have to resort to something else. Can’t remember what he said but from what I understand is that some legal action will take place. I don’t understand why they can’t just accept what I can give them. He’s also asking for a lump sum but i can’t give him a lump sum more than $50 right now, my car is broken i have to find a way to get that fixed too! Can someone give me advice, I want to pay this debt off, I know I owe it, but cannot give them more than $30 per month, I have a baby to feed, can’t even afford rent! I’m really broke I don’t know what to do I don’t want to get sued, can they sue me if they refuse to accept my offer?
I checked the law firms website, looks pretty legit, his name is Marvin S. C. Dang, got his resume and everything…didn’t speak to him but someone else that works there. They specialize in this stuff…does this mean anything? Do They have any control or should I go thru a debt settlement company? I check the statues of limitation in my state and it has not expired yet.
