uk bankrupcy law: I lent brother money, he paid me back, went bankrupt, now i have to pay it back?

March 9th, 2010

I lent my brother £2000.
He got out a loan specifically to repay his debts, and he paid me back.
5 months later he went bankrupt.
one year later I recieved a letter saying that I must pay back the £2000 to the banckrupcy reciever as by paying me back within 6 months prior of going banckrupt it showed a preference payment and that the £2000 must be given back to the loan company.
I have 7 days to pay it back or they start court proceedings.
1. I don’t see how a loan company can lend someone money on the understanding it is to get rid of someones debts and then I who have nothing to do with the loan have to pay it back.
2.If they are legally entitled to my money, is there not a time limit between how long the banckrupcy people have to request the money back from me. As it is taken them a year to ak for the money back and i no longer have it.

? Is the statute laws 4 paying back an auto loan in Tx ? It’s been over 4 yrs. & the Co. is now wanting $?

February 14th, 2010

Had to let a car go back , on Sept. 29th. 2002 , it’s been exactly 4 yrs. 7, mos., and 11 days . I’ve never been taken to court . The car was sold at an auction. I live in Texas . Isn’t it 4 years ? I was just contacted this week to pay off remainder of balance . Should I go ahead and pay , or has the SOL ran out for them ?
I just want to say that Texas websites DO say 4 years on auto loans as does the Texas Attorney General . This is the only debt that I am behind on . And I want to say , that at the time I had no money to keep my car , and now at the time I have no money to pay back the loan . I am wanting to take advantage of the SOL , as my defense …not as a way to get out of paying a debt . I am a fair and honest person …just fell on hard times …….
Thanks spifiman for your info. helps me relax a bit .

Can I be arrested for recieving a payday loan and agreeing to do a post dated check to pay it back?

January 23rd, 2010

I recieved a pay day loan via the interent a couple years ago. I live in NY and I know payday loans are illegal in NY…But this company must operate in a state the allows them to loan to NY residents…Anways, the money was not in the account when I said it would be because I lost my job and now a 3rd party collector is calling a saying I can be arrested for writing a “bad check”. Is this true? AM I subject to the state’s laws that the compant operates in? Please help
