Can anybody tell me anything about child support laws?

I’ve asked about child support before, but this is a different situation.

My boyfriend and I moved to a new town and got new jobs over the summer. He has an 8-year-old daughter with his ex-wife, to whom he pays child support. The first paycheck for the new job did not take out the child support, and neither did the second. So he calls his ex-wife and tells her that she needs to get in touch with the agency or whatever and get it seen about. To this day, no child support has been taken out and he started the job one of the last couple days of June.. perhaps the 29th.

Yesterday, she leaves me a message on facebook (she next to never pays her phone bill) asking for my boyfriend to call her, it’s important. I tell him and he decides he’ll call her this weekend when we go back to our hometown to visit. This morning, his step-mother calls me to tell me that my boyfriend is in some serious sh**. I’m not exactly sure how it went down, but because he did not contact the state to tell him where he worked, his license has been suspended as of September 1. Which was 15 days ago. And we have had no knowledge of this! Now they want to take him to court to get $2000+, which is double what he should actually owe if he missed 2 months of payments!

Our financial situation has been terrible since we moved (the worst move of my life). My income was supposed to be a nice 33k, but because of certification issues and other things, I am making student wages until I can take care of it (probably the end of the year). So I basically bring home the rent check at the end of the month. I also have a student loan I am paying back ($200/month), plus we have power, water, cable, cell phone, insurance, etc… other bills that HE is having to pick up! We were able to save a little under $1400 to help get us through the end of the year. But it seems all of that is going to go towards repaying the child support.

Now after all of that.. is there anything we can do about how much is owed? It’s $120/week.. and it should only add up to something over $1000. Can we set up a payment plan? There is no way on this Earth we can cover it all at once!!

Also, bonus question I guess… we are in Georgia. I was told that the child support laws changed to include the mother’s income as well as the father’s. Well, if she and her current husband don’t work (lazy SOBs), wouldn’t that only raise his support amount? Should we even try to go back to court to readjust the amount? She doesn’t have young children to keep at home.. all of her kids, including my boyfriend’s, are in school.

Sorry such a long question!! Any help? Or anybody want to make me feel any better about this situation???? :) I could really use it!!
Okay, I am understanding that it is his responsibility to inform the agency.

No, neither the mother nor stepfather work. Just plain sorry (my opinion!). I believe they are living on the child support and any money from the stepfather’s parents (with whom they live). They may also have welfare, since my boyfriend had to sign some papers to confirm his contribution dealing with food stamps.
LadyB — EXACTLY! They are just living off what he gives them. And she calls all the time asking for money…. I mean, it’s not like we want sweet girl to go without, but it’s borderline ridiculous. We have enough of our own financial problems without worrying about his ex’s! She had a job for 3 months though, got to give her that *eye rolling.*
maccrew – i only mentioned that they were in school to say that there was no reason for her to sit at home on her @$$ and not have a job.

Have you heard about Joe the Republican’s day?

What do you think? Is this an average day in the Life of Joe Republican?

Joe gets up at 6 am and fills his coffeepot with water to prepare his morning coffee. The water is clean and good because some tree-hugging liberal fought for minimum water-quality standards. With his first swallow of water, he takes his daily medication. His medications are safe to take because some stupid commie liberal fought to ensure their safety and that they work as advertised.

All but $10 of his medications are paid for by his employer’s medical plan because some liberal union workers fought their employers for paid medical insurance – now Joe gets it too.

He prepares his morning breakfast, bacon and eggs. Joe’s bacon is safe to eat because some girly-man liberal fought for laws to regulate the meat packing industry.

In the morning shower, Joe reaches for his shampoo. His bottle is properly labeled with each ingredient and its amount in the total contents because some crybaby liberal fought for his right to know what he was putting on his body and how much it contained.

Joe dresses, walks outside and takes a deep breath. The air he breathes is clean because some environmentalist wacko liberal fought for the laws to stop industries from polluting our air.

He walks on the government-provided sidewalk to subway station for his government-subsidized ride to work. It saves him considerable money in parking and transportation fees because some fancy-pants liberal fought for affordable public transportation, which gives everyone the opportunity to be a contributor.

Joe begins his work day. He has a good job with excellent pay, medical benefits, retirement, paid holidays and vacation because some lazy liberal union members fought and died for these working standards. Joe’s employer pays these standards because Joe’s employer doesn’t want his employees to call the union.

If Joe is hurt on the job or becomes unemployed, he’ll get a worker compensation or unemploy ment check because some stupid liberal didn’t think he should lose his home because of his temporary misfortune.

It is noontime and Joe needs to make a bank deposit so he can pay some bills. Joe’s deposit is federally insured by the FSLIC because some godless liberal wanted to protect Joe’s money from unscrupulous bankers who ruined the banking system before the Great Depression.

Joe has to pay his Fannie Mae-underwritten mortgage and his below-market federal student loan because some elitist liberal decided that Joe and the government would be better off if he was educated and earned more money over his lifetime. Joe also forgets that his in addition to his federally subsidized student loans, he attended a state funded university.

Joe is home from work. He plans to visit his father this evening at his farm home in the country. He gets in his car for the drive. His car is among the safest in the world because some America-hating liberal fought for car safety st andards to go along with the tax-payer funded roads.

He arrives at his boyhood home. His was the third generation to live in the house financed by Farmers’ Home Administration because bankers didn’t want to make rural loans.

The house didn’t have electricity until some big-government liberal stuck his nose where it didn’t belong and demanded rural electrification.

He is happy to see his father, who is now retired. His father lives on Social Security and a union pension because some wine-drinking, cheese-eating liberal made sure he could take care of himself so Joe wouldn’t have to.

Joe gets back in his car for the ride home, and turns on a radio talk show. The radio host keeps saying that liberals are bad and conservatives are good. He doesn’t mention that the beloved Republicans have fought against every protection and benefit Joe enjoys throughout his day. Joe agrees: “We don’t need those big-government liberals ruining our lives! After all, I’m a self -made man who believes everyone should take care of themselves, just like I have”.

Legal question about a old debt?

I don’t need anyone putting me down and calling me a deadbeat PLEASE just some advise!!
In may of 2008 I had a payday loan through a on line company (bad idea I now know) they were to take the payment out of my checking, when they tried to take the money they notified me and said there was not enough to cover the payment. Turned out a direct deposit that was supposed to be made wasn’t. I said I would mail a money order which I did. I thought this was cleared up. I have looked high and low for my M.O. receipt and I cant find it, therefore if said company says they didn’t receive the payment then I do feel obligated to pay it yet again as its my bad that i lost my proof of payment…

Now over a year later i get a call from a company Eclipse Resolutions LLC in New York they have a called 4 or 5 times and leave a message I have tried to return their calls to find out what it was they wanted. When I did get a answer the person I was supposed to talk with was never around and there was no voice mail. So I continued to try and reach someone. I called this AM and spoke with someone they are calling in regards to the payday advance I described. I told them I need to see some documentation, something in writing…. OK fine but the secretary was out maybe if I call back the next day they can email or fax me something.. so I chat with this person for a bit, I expressed that IF I receive something in writing and this seems valid I can work out some type of agreement. But I was not unwilling to just send them money…. His response was “well you have screwed up get a lawyer” and he hung up on me…
So I called back spoke with someone else (at that point I still didn’t know what company I was dealing with) I tried to talk with him and was interrupted a number of times unable to ever finish a sentence, he then told me that If I didn’t call back tomorrow and set up a payment agreement and get them a payment via, checking account or debit/credit card by the 3rd that they were sending paper work to my County because I wrote a bad check across state lines and committed a felony offense. I told him again that if they sent me something in writing to validate the debt I would work out a plan to pay the debt starting 8/15 the earliest I would have money available.. He then proceeded to tell me that they were trying to work with me and it was what it was, if i didn’t have the money to them by the 3rd then i can expect it to be turned over to the county and he could no longer speak with me as he was leaving the office and the soonest I could get something in writing was via fax or email tomorrow IF I called them tomorrow and he wouldn’t even take my contact info (email/fax/mailing) so that first thing tomorrow they could get it sent to me. I also asked why I had not received anything up to this date and his response was they will not waste money mailing me a bill.

I am wondering if you can please tell me how to handle this situation? like I said if the original company claims they didn’t receive payment then I feel obligated to pay it. But I also do not have a good feeling about this other company. I am at a loss at this point and unsure what to do.
I have been trying to research this company and have came up empty handed. When they leave a message they say a name, and a call back number and case number: xxxxxx

I appreciate any advise that you can give me. I have contacted a lawyer for his advise but haven’t heard back yet…

They told me that another company purchased the debt and they represent that company, they themselves are a litigation company…. I agree if i can tfind the reciept then i need to pay it and i am willing to do so, If they can show me in writing that i owe them and that it would be reported on my credit as paid in full… he told me they can email me an agreement but its up to the credit agency to remove it from my report.

Question about NC pawnshop laws?

A few weeks ago I got a loan on my HDtv. The other day I went in to pay off what I owed and get my tv back. The guy at the pawnshop tells me that the pawnshop was broken into and my tv was stolen. He then tells me that the most they can give me for my tv is the amount I got loaned($50),but the tv is worth way more than that. I then go home and read the pawn ticket that I signed when i pawned it and it says that they have to try and find a replacement tv. I then go back to the pawnshop and tell the guy working what I read in the contract. He basically tell me that I’m wrong and that they dont have to get a replacement, just reimburse the money i got on loan. He then tells me to go home and theyll call me when they get a settlement from the insurance company.

This kind of sounds like BS to me. The pawnshop cant get the replacement value for my tv (from insurance) and then only give me $50 for it, can they? I dont know North Carolina law good enough to know if they’re trying to screw me or not, so any info on this would be greatly appreciated.

Does anyone know anything about old debts and bill collector laws?

I know that statues of limitations on debts, this one is a substantial loan, in the state of NY is 6 yrs. According to info i have obtained the law states the last payment made or the chg off date is the date one goes by for when the statues start. On my credit report for this one loan, it shows 3 charge off dates? why 3? and which one do i go by. Next question is this: I was told that after the loan went into default, because i left the state the loan originated in, the time freezes until i move back into the state, and was also told this loan is being brought back up because the IRS did an audit and because the loan is over 10k, they are coming after my sister and I again. She co signed on the loan. They told her a much higher pay out that myself. I was offered 2900 to pay off and she was offered 10k to pay it off. I told him it was beyond statues and he said i was wrong because the time froze on this loan because i moved out of state. Is this correct? and can they collect 2 different amounts from my sister and I. He was also telling me about my credit and even read everything on my credit report. Actually he was quoting an awful lot of lies on top of it, but they are known to strong arm and bully. This company is out of Cali, i am in Mass and my sister is in NY. To file a judgement in court against us,would they not have to go to courts in each of our states, or just the state the loan originated in and what is he likeliness of that happening? and how do i find out the correct chg off date of this loan?
I co own a house with another individual and i was told they will take me to court and put a lien on “my” half of the house that im deeded on. Says that is legal to which im not sure about.
The loan was for a mobile home,, it got foreclosed on. The company i had the loan from never retrieved the property and this was back in 2002. The mobile home seems to have disappeared off the face of the earth. The loan company has no idea where it is. So my other issue was this, had they come for the mobile home when i vacated,it would have been re sold or auctioned off causing my loan to go down in amount and i would have been responsible for the remainder, just like a car.
Now because the home was never retrieved they are saying i have to pay the entire loan. And if not, then they are going to put judgements against myself and my sister. can they put 2 judgements on against 2 different people? My sister was told they were going to destroy her squeaky clean credit if she didnt fork over 10 . They actually gave her 2 days to pay it. I told the man, i was not working, have no way to pay, and if hes going to put a lien on my house , go for it, its at risk with the economy right as it is.
Basically the man was ticking me off with his lies so i said what i said.
He wished me luck and ended the call.
Anyone have any answers?
The biggest thing here along with how old this loan is , is no one ever got the mobile home and now its disappeared and i never had the chance to lower the balance.
Any help would be appreciated.

I had fallen into some severely hard times, im not a dead beat people.Things happen.
