A question about a mortgage loan modification?
February 21st, 2010March of last year I lost my job through no fault of my own company went out of biz. I have a mortgage where my APR is 9%. In July I called Bank of America where I bank and ask about a refinance she said they cannot do one because one we owe 155k home is worth 120k and I am on unemployment. She did offer the making homes affordable program and switched me over to the loan modification dept. I talked to them and they took all of my income and expenses over the phone then they asked me to fax pay stubs, hardship letter, unemployment proff. they told me it will take 30-45 days to review the info. Did not hear anything from them and then I called on day 45 they said they are still reviewing it. I thought this was a wash, we have also made our payment on time every month. Then this last week Fed-ex showed up with an envelope with a one page letter from BoA letting us know what a trial payment will be our Original payment was 1600 trial payment is 1090 it also said in a few days you will get more details. Yesterday Nov 2 another package showed up from Fed ex this time a thicker package with a check list of more pay stubs, tax documents ect. This also had three cupons with a trial payment of 1077 one due Dec 1, Jan 1, Feb 1. I still have not paid anything for Nov yet. So i went online to make a Nov payment and it was blocked and said call #1866 as this account has a special curmenstance. I called them up talked to a rep they said you are now in a trial payment asked it they can set up an automatic payment for that I said sure they set it up to be drafted Dec 1st. I asked him about the Nov payment I have not made one yet he told me dont worry about it. I also asked about if this was going to hurt my credit score he told me there is no way shape or form it will hurt me credit score. Only way it will hurt your score if you dont pay your trial payment. I have been reading some people have been taking a hit on there credit even as they where told by there lender it will not. I recently got an offer from a credit card that gave me a 4.99% until balance is paid in full, they gave me a check to write out on my line of credit to my checking account this was 7k. I would hate for my loan company to put a late then my credit card would come back with the universal defuate clase and jack my APR up. Do you think they can disclose this in writting or record a conversation with them.
Any thoughts would be great.

house at 125 % loan to pay them back now this company has me on a 3 yr leg and arm. they also have a stiff 6 % early payoff penalty. it was my understanding at time that if rates whent down so would mine this is not so. im about 1 yr and 1/2 into this mortage and with the way housing is falling im in a crack before this happened i only owed 60.000 on a 125.000 home is ther any hoper help for me by the way im paying about 10 intrest on this 1100.00 a month my credit is good. do i need to see a attorney plz help
Help understand a credit to loan but I have to pay it anyway?
February 20th, 2010I have a loan with years of excellent payment history until Jan. of this year. In Jan. the terms changed a bit and I incurred a $40 late fee because my bank (same as who the loan is thru) paid it after a holiday instead of before. So 1 day late. They called the next month…said I was $70 behind…would waive the fee though….I paid the $70 and thought I was square. Next month…auto payment on the usual date – expect that things are good. NOPE…I get a call. Well the balance paid that one fee and you actually owed more , we’re sorry we didn’t make that clear, but now you owe $56 more dollars and you’re late again. WHAT?????? This is a snowball effect. SO…I can see how I owed more because of fees etc..and I’m willing to pay it to be done with it (she promises me to credit the fees in the end). BUT…because I was late 2x (not really though!) the took the loan from 8% to 28.5%……did you fall over? And we have a near perfect credit score. So…she says…and this is where I”m confused. NEXT MONTH….you will owe your normal $215 ish….another $40 late fee and the NEW $289 INTEREST charge because you moved into the penalty rate! She’s willing to ‘credit the excess interest charge and fees, move my rate back to 8%. BUT….I still have to pay the whole whopping $500 next month because the credit will not apply to the payment due as she can not do that by law. —- I’m having a hard time understanding where that money really comes off then????
Can anyone make me understand?
I mean…if I paid it this month, I would hope that next month or so, the credit would make my payment less but she says no. It comes off the balance? ARGH!
It was a supervisor I spoke to…she did waive all the fees AND the excess interest charge. However…. I still have to pay it now and she says it will come off “balance” of the loan? Does that make sense? Will it?
