Legal question about a old debt?

April 19th, 2010

I don’t need anyone putting me down and calling me a deadbeat PLEASE just some advise!!
In may of 2008 I had a payday loan through a on line company (bad idea I now know) they were to take the payment out of my checking, when they tried to take the money they notified me and said there was not enough to cover the payment. Turned out a direct deposit that was supposed to be made wasn’t. I said I would mail a money order which I did. I thought this was cleared up. I have looked high and low for my M.O. receipt and I cant find it, therefore if said company says they didn’t receive the payment then I do feel obligated to pay it yet again as its my bad that i lost my proof of payment…

Now over a year later i get a call from a company Eclipse Resolutions LLC in New York they have a called 4 or 5 times and leave a message I have tried to return their calls to find out what it was they wanted. When I did get a answer the person I was supposed to talk with was never around and there was no voice mail. So I continued to try and reach someone. I called this AM and spoke with someone they are calling in regards to the payday advance I described. I told them I need to see some documentation, something in writing…. OK fine but the secretary was out maybe if I call back the next day they can email or fax me something.. so I chat with this person for a bit, I expressed that IF I receive something in writing and this seems valid I can work out some type of agreement. But I was not unwilling to just send them money…. His response was “well you have screwed up get a lawyer” and he hung up on me…
So I called back spoke with someone else (at that point I still didn’t know what company I was dealing with) I tried to talk with him and was interrupted a number of times unable to ever finish a sentence, he then told me that If I didn’t call back tomorrow and set up a payment agreement and get them a payment via, checking account or debit/credit card by the 3rd that they were sending paper work to my County because I wrote a bad check across state lines and committed a felony offense. I told him again that if they sent me something in writing to validate the debt I would work out a plan to pay the debt starting 8/15 the earliest I would have money available.. He then proceeded to tell me that they were trying to work with me and it was what it was, if i didn’t have the money to them by the 3rd then i can expect it to be turned over to the county and he could no longer speak with me as he was leaving the office and the soonest I could get something in writing was via fax or email tomorrow IF I called them tomorrow and he wouldn’t even take my contact info (email/fax/mailing) so that first thing tomorrow they could get it sent to me. I also asked why I had not received anything up to this date and his response was they will not waste money mailing me a bill.

I am wondering if you can please tell me how to handle this situation? like I said if the original company claims they didn’t receive payment then I feel obligated to pay it. But I also do not have a good feeling about this other company. I am at a loss at this point and unsure what to do.
I have been trying to research this company and have came up empty handed. When they leave a message they say a name, and a call back number and case number: xxxxxx
The company that has been calling me is:
Elcipse Resolutions LLC a litigation company
Tonawanda, New York
1-888-368-1116

I appreciate any advise that you can give me. I have contacted a lawyer for his advise but haven’t heard back yet…

Thank you very much for your time.
They told me that another company purchased the debt and they represent that company, they themselves are a litigation company…. I agree if i can tfind the reciept then i need to pay it and i am willing to do so, If they can show me in writing that i owe them and that it would be reported on my credit as paid in full… he told me they can email me an agreement but its up to the credit agency to remove it from my report.

My student loan company is giving me the runaround on trying to get a forbearance….?

April 7th, 2010

I talk to two different companies multiple times a week about the same loans. The one is the originator the other is a collection processing place. Its to the point where I don’t even know who I’m calling because they freely pass my calls back and forth.

They sent me forms I mailed them to the one company..they said they never got them. I then faxed them to that company, again they claim not to have gotten them.

I faxed the forms to the originator company and they say they never got the first and now the second they say are old forms and won’t accept. (though I was given them after they apparently stopped using them) This company also won’t give me an address. I have no idea where they are even located and they went out of business.

I am going crazy trying to work with these companies and don’t know what to do. They change their requirements every time I call…..

Is there anything I can do?
And don’t tell me to just pay them, because I would be if my job didn’t cut back my days.
these are private loans

ALSO BURNED BY ROSEDALE FINANCIAL!!!?

April 4th, 2010

What was thought to be an answered prayer turned into a nightmare!

I received a phone call from Rosedale Financial Services saying me and my husband were approved for a loan. I had contacted lending tree.com via Internet, so I am guessing this is how Rosedale got my info. I gave Mr. Murphy, from Rosedale Financial the information he needed to process paper work, of course being thankful we found a loan.
We received a contract via fax to sign that looked really legal with a loan number, loan amount, payment schedule, maturity date, ect…, and of course the COLLATERAL SECURITY PAYMEN, which we signed and faxed back to Rosedale Financial Services at 347-436-9088. After 2 weeks of phone calls and faxes back and forth, we just prayed that this was real. We spoke to Micheal Murphy at 1-888-290-0560 ext. 461 several times and then someone named Stanley Sheppard, who claimed to be Mr. Murphy’s supervisor. I have tried all day today 8/25/09 to contact them because today is the day the money was going to be direct deposited to our account and the call goes to customer service voice mail or Micheal Murphy’s voice mail. No return calls from them. I have requested my money be sent back and still no money or no communication with Rosedale Financial. I have filed a report with my local sherriffs department and also Money Gram and the Trade Commission.

I even received an approval letter from Rosedale Financial Services stating that disbursements of the full loan amount of $115,000.00 via direct deposit on Aug. 24th by 5 PM Central. Any calls should be directed to Micheal Murphy at 1-888-290-0560 ext. 461. The letter was signed by a S. Jefferson (Phillip S. Jefferson CEO of Rosedale Financial Services). I had put a contract on a home and had land cleared which I was going to pay for out of the loan. The 1-888-290-0560 number is also connected to some kind of national answering service which I learned by error. If you dial the 1-888-290-0560 and when it answers hit the number 0 twice it will transfer you to this automated service and you can hear the options of how to set up your business mail box. In listening to this I also found out that these extensions at Rosedale financial should also have other numbers to contact such people as Micheal Murphy. The service of course will not give you those numbers. Other extensions at Rosedale Financial are as follows: 461 Micheal Murphy, 361 Scott Kamble, 0 Customer service and Stanley Shepard, 561 Greg Burnett. I was just trying these different extensions but of course all went to voice mail. Please let me know if anyone has found out anything about these people. Any feedback will be appreciated.

I need some advice because I haven’t had a car for 3 weeks and the insurance is not sending the check?

March 29th, 2010

I totalled my car and they’re supposed to send something around 32 thousand to pay off the loan amount to the bank so I can finance a new car.

My adjustor already sent the letter of guarantee to my lienholder (credit union/bank financing my car), but now she states that they’re not replying back to her with a fax. I’ve called every day for 2 weeks finding out if they’ve faxed eachother and each time they say no there’s no fax. It even took my adjustor a week to even send the letter of guarantee in the first place, now supposedly my bank is not sending it back.

What is going on. What do I do, I haven’t driven for so long and I need to go to work otherwise I’m screwed. Are they playing games with me? I don’t see why the adjustor would do that
