2 1/2 weeks later still NOT getting anywhere…?

June 9th, 2010

Im sure this still sounds like a broken record, but I am at witts end ..I am in Galveston Tx home to the landfall hurricane IKE 18 days ago…
I use to have a job but IKE took that and ran with it along with part of the roof to my house, I have no problem getting a job, and am dilligently looking but no one here is hiring because there is very little left amidst all the destruction….
I applied for FEMA help, they denied me because I have home insurance, which WONT PAY FOR windstorm damages, FEMA referred me to SBA disaster loans and they denied me and referred me back to FEMA, so I feel like I am getting the paper push run around, tried for emergency unemployment, no good there either and trying to get food stamps like everyone says I can get during this hard time is also a big joke….today is the 1st and my mortgage people refuse to give me a deferred payment, even though this is a declared disaster area, I used what small savings I had in hotel bills, gas to run all the faxes around that got denied and now I just dont know where to turn, not looking for handouts, just others who have been thru this and what did you do and where did you turn for assistance?

Complaint against realtor – justified? What to do?

May 31st, 2010

I recently purchased house in California.
When the offer was written it included brand-new appliencies, hardwood floors throughout the house AND $5000 closing credit. My realtor contacted me day after submitting offer telling me that seller doesn’t want to do hardwood floors throughout but instead suggests carpet on stairs and tile downstairs. I agreed, counter offer was faxed to me (really bad copy). Realtor told me counteroffer had what we discussed – the changes to floors – no mention of any closing money. When I came to close loan they told me – in counteroffer there was no mention of $5000. So I had to pay extra!
Now realtor claims she explained everything but I have all emails from her with no mention of money.
She screwed up and didn’t explain it to me – I think she should pay this $5000 out of her cut. What are my chances of getting it?

Has anyone else had this experience with Wells Fargo?

May 25th, 2010

I have a car loan with WF and owe 3063 and some change. When I got the loan I was making double what I do now and making my payments were easy. Over the last two years, I fell on hard times (haven’t we all) and called the company to ask for help and to see what my options are/were. I was told I could put in an offer to settle below what I owed if I could prove I wasn’t making what I was when I originally purchased the car. I gave them an offer and they accepted. I was told that I would have the paperwork faxed to me and that I was the proud owner of my car!!!

The next day (original call was a Tuesday), I got a call from a different person saying I still owed 900 bucks and that my car was in repo. When I told them I had spoken with (Moron’s Name witheld) *** and that we were settling the account, I was sent to a manager and told that Moron, didn’t have that authority and that basically for 2 days I was lied to. When I lost my cool and reiterated my entire 2 day ordeal, I was told in no certain terms too bad, so sad. Has anyone else had horrible experiences with this company? I cannot imagine that I am the only one that has had problems. For two weeks they called me 12-15 times a day, and actually called my job and demanded that I speak with them, because I had stopped answering my home phone. When I told them I could get fired for getting personal calls they told me “well, we’d stop bugging you if you would pay us.” I understand they are in business to make money but to be degraded and belittled is very upsetting and to be sent to repo for no good reason, seems a bit extreme.
I was screening them, I have 10 different numbers saved in my phonebook for them. Because I didn’t pick up my phone anymore, they called my work, they are crazy.

What are my legal options when my car was mistakenly repossessed?

May 22nd, 2010

Last month my car was (correctly) repossessed on 3/11/09. I was able to borrow some money and get it back the same day. Then this past Sunday, 4/19/09 I got a knock on my door at around 8pm. When I answered, it was the same repossession company that had taken my car the month before, and the guy at the door told me he was here for my car again. I was very confused, as my payment in the middle of March had been made in full and up to date, and my payment in April had been made a day early. I showed the guys (there were two, which is one of the reasons I didn’t come downstairs legally armed) my copy of the payment from March, and although I didn’t have a paper copy of my April payment, I was able to get the one guy to listen to the automated recording w/ the loan company stating that I had no payments due, thus showing that I was paid up. I said there was no possible way they were there to take my car. They then showed me their work order, which was originally generated on 3/31/09. This gave me further confusion, as even if there was some kind of problem with my April payment, there work order was generated before that payment was due. I again stated they weren’t taking my car, but they told me that there was nothing they could do, they had their orders. Rather than risk any serious altercation, I opted to hand over my spare keys and allow them to take the car. I have terrible luck, and I decided something must have gone wrong and I was indeed at fault.

After calling off work (I am almost forbidden to take off work on Mondays as my job duties have to deal w/ preparing for new music, movie, and book new releases that come out every Tuesday, and since I don’t have an understudy or anything, I’m the only guy in the store who can do it, but I was able to plead to the right boss and instead just had to bust my ass even harder on Tuesday before the store opened), I tried to get some sleep. The next morning, when I called the loan company, I eventually was told that it was a mistake, and that my car was indeed not scheduled to be repossessed. The loan company informed me it was a paperwork error with the recovery company, and that I could contact them myself and arrange to get my car back. I called the recovery company, and was given the number to one of their drivers and told to call him. When I called, he informed me he needed to get the release faxed to him, and that he’d call me back. An hour and a half later, I had not received a phone call, so I called the recovery company and they told me they’d call their driver and make sure he got the fax. About 15 minutes later I finally got a call from the driver. He asked me when I could come pick up the car. I was pretty pissed off at that point, that they had towed my car an hour away and now expected me to pick it up, but I was more worried about getting my car back before some other paper work error caused them to mistakenly auction it off or something worse.

I eventually got my car back. Some of the things I was most upset about is that not a single person apologized to me. The loan company didn’t go to any steps to get my car back for me, and instead left me to deal with the repossession company. The guys there made me wait around and then expected me to pick up my own car.

What kind of legal options do I have? I’ve seen a few sites stating this is grand theft auto, but I’m not sure if this applies in Pennsylvania, and if it does, what the statute of limitations would be. I’m not really that interested in spending my own money to sue anyone, but I wonder if maybe I can get something from one or both of these companies in compensation. I’m thinking maybe a month forgiveness on my loan and a full tank of gas maybe? Anyone have any advice?
