I just received a life insurance policy check and I am filing bankruptcy in Jan. What are my options?

May 21st, 2010

My mother in law died and she left us a significant amount of money. We owe a relative money for a loan(we have a written and notorized agreement). We have a file date set with our lawyer for january4th. What are our opyions? Can we use part of the money to pay off the relative or do we have to hold it until the bancrupcy? We live in Ohio. The checks say cash immediately and only have a 30 day period to cash.

Crazy in-laws…what would you do? Sorry it’s long…?

May 17th, 2010

My Father-in law (FIL) recently lost it and called my husband and myself some horrible things, and has even said mean things about my Mom. It all started when (after getting pregnant with baby #2), my husband and I gave some of my husband’s old furniture to my Mom so we could get some toddler furniture. Besides the fact that my FIL gave it to my husband 12 years ago, it is antique, and neither one of us like it. My Mom planned to hold it until my 1st child was old enough to see if he would like it for himself. Anyways, my FIL flipped out and said that my husband cannot give the furniture away (even though it was more of a loan) to someone outside of the family. He then called my husband names, threatened him, said that I was controlling, and called my Mom controlling.

My husband and I have seen some strange behavior from my FIL before…for example, he didn’t talk or visit his 98 year old mother in the nursing home for over a year b/c he had to pay capital gains taxes on an inheritance from her. Needless to say, he is a little off. Well, we have overlooked most of his past tirades, but cannot overlook personal attacks and threats. We gave him back the furniture (he is storing it along with his 7 other furniture sets) b/c we don’t want to hear his calls and threats anymore. Also, we have since cut all ties, have not answered his calls, and do not plan to see him anytime soon. He has not apologized or anything and continues to leave mean / strange phone messages. Now, he is acting like he is the victim and that we are keeping him from his grandchild (without warrant). Frankly, I do not want my son or my future baby around him when he is acting crazy. He can be quite scary.

Well, my baby is about to turn 2, and my family is asking if we are inviting my FIL to his b-day party. My husband says no way, and I agree. What would you do? Part of me feels guilty…but then I replay some of the mean phone messages from him, and I don’t feel so guilty. Has anyone else ever cut out their baby’s grandparents?

Oh, my mother-in-law is deceased. My FIL is remarried, though. There is a lot more crazy things I could tell you about my FIL, but I don’t want to write a book. Let’s just say that I have even considered getting a restraining order.
I should mention that the furniture was not special to my FIL…it was a gift to my husband. We would’ve asked my FIL if he wanted it, but he has 5 bedrooms (complete with furniture sets) and 2 full spare sets in storage (i.e. his basement). His house is packed….he likes stuff and does not throw anything out. Again, I should re-iterate…my Mom was holding the furniture for us until my son was old enough to take it from her (if he so desires).
Also, my FIL is not mentally-ill…at least he has not been designated so. He just is mean and stubborn. He has done some crazy things, though.
Addtn: My FIL has caused many scenes in front of family. He was also once kicked out of a nursing home (when he was yelling at his 98 year old mother, who has never said a mean thing in her life by the way).

Difference with Mother in law .?

May 16th, 2010

My husband and I had a loss in income . Do to one of us getting laid off . We were trying to keep all bills paid ourselves . My mother in law found out . And offered to pay off our vehicle for us . Which she is a very nice woman . We accepted and agreed to start paying her back in 09 . After our income tax arrives .
All in agreement ….. BUT………
Four days later she stopped by the house . And added on some stipulations . 1. Being that she wants to hold the title to “her” vehicle . Since she paid it off . Now mind you . We have paid more on the vehicle than she did at pay off . It is our vehicle since we are to pay her back ( in like 60 days ) . The loan is in mine and my husbands name .
We hold insurance on all our vehicles . The other one we paid off a long time ago …
2. She says our 17 year old daughter cannot drive this vehicle when she gets her drivers license . The other vehicle is temper mental and we would not feel safe for our daughter to drive it down the street !
When our daughter receives her license she will of course be added to our insurance . We have full coverage of the vehicle in question .
Am I wrong to stand up and say . “Wait a minute ” ? With these new stipulations ?
As she did not mention this at the time of our agreement ? I don’t want to sound disrespectful , or rude towards my mother in laws help . But it is our vehicle ! We are grown adults , and she is the one that offered to help .
My daughter will need a way to and from work . Is she right in putting stipulations on our vehicle ?
Whew ! Thanks . I thought that maybe I was thinking ugly about the situation ! She is very good with her family . Stands up for us ALL ! When we are in need . She was left a large inheritance from her mother and father millions (only child). She has the money to loan . Not that she HAS to loan any out .
That’s why I don’t feel bad … I guess . And for the fact that we usually get a large income tax return . Is why I feel as though she knows she will get her money . I know she doesn’t think she won’t get paid back . As that is not how my husband and I are . We HATE borrowing money . But this was a needed time to do so .
Please don’t think horribly of my mother in law . As I don’t . But I just do not think she has the right to keep adding stipulations after an agreement has been made . AFter all she is the one that says my daughter needs to get a job … LOL How does she think she will get there ? Thanks for all your answers …..
Felicia S. , A firm no on the trust issue . As we have never wronged her . We are usually the ones that go to help her out . As far as chores and what not , that a senior citizen may need help with .
I do however believe that it is the control issue . As this gives her a “say so in one of her grown children’s lives …. LOL …
